The ensuing terms and conditions establish a legally binding agreement between you and Lumina Lighting Inc, denoted herein as either 'terms and conditions' or 'this agreement.' For the sake of clarity within this agreement, Lumina Lighting Inc will be identified as the seller. Prior to acceptance, please carefully review the terms and conditions outlined in this agreement. The purchase of products by the buyer explicitly depends on the acknowledgment and acceptance of these terms and conditions. Buyer affirms acceptance of the specified terms and conditions by initiating a purchase from Lumina Lighting Inc, placing an order, or engaging in shopping activities on any Lumina Lighting Inc website. These terms and conditions are applicable to all purchases and orders, whether conducted via email, verbal communication (by telephone), or written orders dispatched by the buyer to Lumina Lighting Inc. Any conflicting terms and conditions provided by the buyer are expressly rejected by Lumina Lighting Inc and will not be integrated into this agreement. Please note that the terms and conditions outlined herein may be subject to modification without prior notice. However, the terms and conditions in effect at the time of the buyer's purchase or order placement will govern, unless otherwise mutually agreed upon in writing by Lumina Lighting Inc and the buyer.

Installation of Products

The Buyer expressly acknowledges and agrees that, should it become necessary to perform any work on line voltage for the utilization of the Seller's Products, the Buyer is obligated to engage the services of a qualified and licensed electrician for such line voltage work. Any installation of the Products by an individual lacking the qualifications and licensure as a qualified electrician shall be undertaken by the Buyer at their own risk and liability. The Seller explicitly disclaims any responsibility for, and does not accept or assume any liability connected with, line voltage work associated with the use of the Products, the electrical installation or modification of any of its Products, or injuries or damages arising in connection therewith. The installation of the Products must adhere to all pertinent local, state, and federal laws, rules, codes, and regulations. The Buyer shall bear sole responsibility for ensuring compliance with such laws. Any improper installation and/or modification of the Products may result in serious harm, potentially leading to death or personal injury. It is strongly advised that the Buyer consult with a qualified, licensed electrician who complies with and acknowledges full responsibility for electrical installations in accordance with all applicable local, state, and federal laws, rules, codes, and regulations.

The Seller explicitly disclaims any responsibility for injury or death arising from the use or installation of its products. Information provided on the Seller's website regarding the installation of the Products is intended solely for demonstration and educational purposes and is not intended for use by any individual other than a qualified, licensed electrician. Without limiting the foregoing, the Seller does not represent or warrant that the information available through this website is accurate, complete, reliable, useful, timely, or current. The Seller disclaims any liability regarding the accuracy or completeness of such information. The Seller assumes no risk or responsibility for the Buyer's use of any content provided on this website. Under no circumstances shall the Seller be liable for any direct or indirect losses or damages arising out of or in connection with the use of the information on this website.

Limited Warranty

The warranty guarantees that products will be free of defects in material and workmanship when the products are installed, operated, and maintained according to applicable codes and regulations, supplied instructions, and under conditions of ‘normal use’ – for the time periods defined below.

Warranty Periods*

Warranty periods designated as "Residential" pertain to properties characterized as single- or multi-family dwellings with three stories or fewer. For all other properties, designated as "Commercial," distinct warranty periods apply.

Limitations and Conditions

The warranty does not apply to products under the following conditions:

• Products subjected to misuse, mishandling, misapplication, neglect (including improper maintenance), accident, vandalism, improper installation, improper packaging of returned products, modification (including the use of unauthorized parts or attachments), or adjustment or repair by someone other than the Seller.
• Damage resulting from power surges, power spikes, or the application of voltages outside the acceptable range defined in product specifications. This includes the use of DC (direct current) power when AC (alternating current) power is required (or vice versa), and the use of non-approved electronic transformers and dimmers.
• Damage caused by 'Acts of God' such as lightning, floods, hail, tornadoes, fires, earthquakes, hurricanes, and other extreme weather events.
• Water damage to products (excluding those specifically sold as Underwater Products) that have been submerged in water, mounted incorrectly, improperly assembled, or exposed to excessive water spray from irrigation nozzles or drainage flows.
• Transformers must be installed according to provided instructions; evidence of improper mounting or wiring voids the warranty. Transformer housings, when mounted on oceanfront properties, must be protected from direct contact with salt spray.
• Normal wear and tear, including patina, oxidation, and color changes in natural brass and copper finishes. Other finishes, such as powder coatings, may discolor or blister when exposed to sunlight, irrigation systems, reclaimed water, sea water, acid rain, and other aggressive agents. Changes due to physical factors are not covered by the warranty. Normal patina or discoloration of finishes on fixtures, including residue build-ups from outside contaminants, is considered part of the authentic beauty of solid brass and copper in outdoor environments. Solid brass and copper fixtures can be cleaned with metal cleaner for customers who prefer to address hard water stains or avoid natural patina.
• Warranties are valid only for the original purchaser and become void when the original purchaser no longer owns the product. These warranties are non-transferable to heirs, subsequent owners, or others.
• Warranties do not cover labor or other costs or expenses related to the removal, installation, or replacement of defective, repaired, or replaced products.
• If a product is covered under the warranties, the Seller may choose to replace or repair the product, or refund the purchase price, at their sole discretion.
• The warranties provided are exclusive and replace all other warranties. The Seller makes no other representations or warranties except those expressly stated herein. The Seller explicitly disclaims all other representations and warranties, whether express or implied, including any modifications or amendments by suppliers or distributors of the Seller.

FOB

The sale is designated as FOB Lumina Lighting Inc Warehouse. When purchasing goods at our location, customers have the option to pick them up at our warehouse in Pomona, CA. Alternatively, they may choose to have us forward the goods to them. If goods are shipped, our responsibility for them extends only until they leave our warehouse and are picked up by the customer's chosen shipper. The customer covers the shipping costs and engages us to dispatch the goods via their preferred shipper, typically UPS. Any issues regarding delivery should be directed to the customer's chosen shipper. If a tracking number is available, we will provide it to assist the customer in communicating with their shipper.

California Proposition 65

WARNING: Products sold here may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. It is advisable to wash hands thoroughly after use.

Limitation of Liability

The preceding limited warranty constitutes the exclusive remedy available to the buyer concerning the seller's products. In no event, and even if any remedy outlined herein fails its essential purpose, shall the seller be liable for (A) any special, indirect, incidental, punitive, or consequential damages, including, but not limited to, loss of profits, business revenues or savings, promotional and/or manufacturing expenses, overhead, injury to reputation, and/or loss of customers, regardless of whether the possibility of such damages was advised or foreseeable; (B) any claims, demands, or actions against the buyer by any third party; (C) any losses or claims, including those for personal injuries or death, resulting from the use or installation of the seller's products; (D) any losses or claims arising from the buyer's implementation of any advice, recommendations, or instructions by the seller, whether based on, resulting from, arising out of, or otherwise related to the products.

Returns

Products may only be returned with the explicit written consent and authorization of the Seller, and such consent may be withheld by the Seller at their discretion. To initiate the return process, the Buyer must contact Seller's Customer Service Department to obtain a return authorization number. It is imperative that all returned Products have a return authorization number from the Seller before being shipped back. Returns must be received by the Seller within 30 days from the product shipment date to avoid incurring a restocking charge.

For a product to be eligible for return, it must be unmarked, unopened, in its original sealed packaging, and, in all respects, resalable. The Seller reserves the right to reject any product returned beyond 30 days from the invoice date. The Buyer is responsible for the cost of return freight and bears the responsibility for any loss or damage during the return process.

Typographical Errors

If any of Seller's Products are mistakenly listed at an incorrect price, the Seller reserves the right to refuse or cancel any orders placed for Products listed with the inaccurate pricing. This applies regardless of whether the order has been confirmed and the customer's credit card has been charged. If the credit card has already been charged for the purchase and the order is subsequently canceled, the Seller will issue a credit to the customer's credit card account for the charged amount.

Governing Law and Jurisdiction

The validity, interpretation, construction, and enforcement of this Agreement are governed by the laws of the State of California, excluding any laws pertaining to conflict resolution with other jurisdictions. The Buyer consents to the personal jurisdiction of the state and federal courts with authority over Los Angeles County, California. The Buyer also consents and agrees that Los Angeles County, California is the proper, exclusive, and convenient venue for any legal proceeding arising from this Agreement. Furthermore, the Buyer waives any defense, whether asserted by motion or pleading, that Los Angeles County, California is an improper or inconvenient venue.

Complete Agreement

This Agreement represents the final, complete, and exclusive expression of the understanding between the parties regarding the addressed matters. It supersedes any prior or contemporaneous agreement, representation, or understanding, whether oral or written, including any written instruction manuals or other terms and conditions found on the Seller's website.

Termination

These terms and conditions apply to you when you access the site and/or complete the registration or shopping process. www.luminalighting.com reserves the right to terminate these terms and conditions, or any part of them, without notice at any time and for any reason. The provisions related to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous shall continue to be effective and survive any termination.

Miscellaneous
